FMCSA requests public comment on Mainline Services, LLC's (Mainline) application for an exemption from certain provisions in the hours-of-service (HOS) regulations. The applicant seeks the exemption for its employees who transport equipment used to clear derailed or disabled trains or debris blocking tracks or railroad rights-of-way when they are responding to unplanned events that affect interstate commerce, service, or the safety of railway operations, including passenger rail operations, and that occur outside of or extend beyond the employee's normal shift. FMCSA is required by statute to publish a notice explaining each exemption request. This notice does not indicate what decision FMCSA will ultimately reach on the request. After reviewing the application, safety analyses, and public comments submitted, FMCSA will grant or deny the exemption.

FMCSA requests public comment on an application for exemption from Lone Star Haz Mat Response, LLC (Lone Star) to allow its "field response" drivers to exceed the hours of service (HOS) requirements for the purpose of returning to their normal work reporting location or residence following hazardous materials incident response operations. FMCSA requests public comment on the National School Transportation Association's (NSTA) application to renew the exemption that permits all commercial driver's license (CDL) applicants seeking a school bus endorsement only to forgo the engine compartment portion of the pre-trip vehicle inspection skills testing requirement, known as the "under-the-hood" testing requirement. Drivers issued a CDL pursuant to the requested exemption are restricted to the intrastate operation of school buses only. FMCSA is required by statute to publish a notice explaining each exemption request. This notice does not indicate what decision FMCSA will ultimately reach on the request. After reviewing the application, safety analyses, and public comments submitted, FMCSA will grant or deny the exemption.

FMCSA announces its decision to renew provisionally for four months the exemption granted to the Association of American Railroads and the American Short Line and Regional Railroad Association and member railroads (the Associations) from the prohibitions against driving after the 14th hour from the beginning of the work shift (the 14-hour rule) and against driving after accumulating 60 hours of on- duty time within 7 consecutive days, or 70 hours of on-duty time within 8 consecutive days (the 60-hour/70-hour rule). The exemption will enable the employees of the Associations subject to the hours-of- service (HOS) rules to respond to unplanned events that occur outside of, or extend beyond, an employee's normal work hours. The Associations are seeking a five-year renewal of this exemption. FMCSA has requested additional information from the Associations and will review the application further before issuing a final decision on the request.

The Department of Transportation (DOT), Federal Aviation Administration (FAA), announces the opportunity to apply for participation in a Radar Data Pilot Program (RDPP), made available under the FAA Reauthorization Act of 2024 (Pub. L. 118-63), Section 905, Radar Data Pilot Program. The RDPP directs the FAA Administrator, in coordination with the Secretary of Defense, and other heads of relevant Federal agencies, to establish a pilot program to make airspace data feeds containing Sensitive Unclassified Information (SUI) and Controlled Unclassified Information (CUI) available to qualified users (as determined by the FAA Administrator). Based on these criteria, the FAA has established policy to implement a collaborative process with the U.S. interagency partners to determine qualification of applicants seeking airspace data feeds containing SUI and CUI related to air traffic within the National Airspace System (NAS) to provide and enable Air Traffic Management (ATM) services and Unmanned Aircraft System (UAS) Traffic Management (UTM) services, or to test technologies that may enable or enhance the provision of ATM and UTM services.

The Fixing America's Surface Transportation (FAST) Act included a provision requiring each State that receives funding under the National Highway Freight Program (NHFP) to develop a State Freight Plan (the Plan) that provides a comprehensive approach for the immediate and long-range planning activities and investments of the State with respect to freight, and meets all the required plan contents listed in the Act. The Infrastructure Investment and Jobs Act (IIJA) added several new required elements and updated procedures for State Freight Plans. This guidance document updates and replaces the prior guidance on State Freight Plans and State Freight Advisory Committees issued on January 12, 2023. It also updates the guidance to be consistent with recent Executive Orders issued by President Trump and DOT Orders issued by Secretary Duffy. Except for any requirements specified in the statutes cited in the guidance document, the contents of this guidance document do not have the force and effect of law and do not bind the public in any way. The contents will not be relied upon by the Department as a separate basis for affirmative enforcement action or other administrative penalty. Conformity with any recommendations in this guidance document, as distinct from statutory requirements, is voluntary only, and nonconformity will not affect rights and obligations under existing statutes.

FMCSA announces receipt of applications from six individuals for an exemption from the prohibition in the Federal Motor Carrier Safety Regulations (FMCSRs) against persons with a clinical diagnosis of epilepsy or any other condition that is likely to cause a loss of consciousness or any loss of ability to control a commercial motor vehicle (CMV) to drive in interstate commerce. If granted, the exemptions would enable these individuals who have had one or more seizures and are taking anti-seizure medication to operate CMVs in interstate commerce.

Michelin North America, Inc. (MNA) has determined that certain Uniroyal Laredo AT and Laredo HT replacement tires do not fully comply with Federal Motor Vehicle Safety Standard (FMVSS) No. 139, New Pneumatic Radial Tires for Light Vehicles. MNA filed a noncompliance report dated November 3, 2023, and subsequently petitioned NHTSA (the "Agency") on November 28, 2023, for a decision that the subject noncompliance is inconsequential as it relates to motor vehicle safety. NHTSA is granting an exemption to Zoox, Inc. (Zoox) to allow it to manufacture and deploy commercially a passenger car, which is equipped with an Automated Driving System (ADS), that does not comply with certain requirements in the Federal Motor Vehicle Safety Standards (FMVSS). Specifically, NHTSA grants Zoox an exemption for its Zoox sedan from certain requirements in eight FMVSS: FMVSS No. 103, Windshield defrosting and defogging systems; FMVSS No. 104, Windshield wiping and washing systems; FMVSS No. 108, Lamps, reflective devices, and associated equipment; FMVSS No. 111, Rear visibility; FMVSS No. 135, Light vehicle brake systems; FMVSS No. 201, Occupant protection in interior impact; FMVSS No. 205, Glazing materials; and FMVSS No. 208, Occupant crash protection. NHTSA is granting Zoox's application on the basis that compliance with these requirements would prevent Zoox from selling, or otherwise commercially deploying, a motor vehicle with an overall safety level at least equal to the overall safety level of a vehicle that complies with all applicable FMVSS. NHTSA grants Zoox an exemption subject to certain specified terms and conditions, including the application of an enhanced oversight condition. Under this condition, NHTSA will issue Operational Authorizations that may update and expand as Zoox's ADS technology matures.
